"specialr report" is next. >> rick: thank you for joining us and welcome to a brand-new hour inside america's news headquarters. i'm rick folbaum. >> arthel: i'm arthel neville. topping the news, onlookers watch in horror as a vintage plane crashes and bursts into flames at an ohio air show today, killing the pilot and a wing walker. >> rick: also a major ruling today by the judge in the george zimmerman murder trial in florida. why a key piece of evidence in the death of trayvon martin will not be presented to the jury. >> arthel: plus, it is the first weekend of summer and millions of americans are soak up the sun. family safely soak in those ray rays. >> rick: we begin this hour with a fox news alert and the u.s. officially bringing charges against nsa leaker edward snowden, including espionage and theft of government property. the charges come just two weeks after the 30-year-old exposed several classified details about the government's secret surveillance programs and marks the first step in what could be a very long legal battle to extradite him from hong kong back to the u.s. he is still believed to be hiding out there. molly henneberg, is hong kong going to fight the obama administration's request to bring snowden back to the u.s.? >> rick, the u.s. made the request and one senior obama administration official says if hong kong doesn't act soon, it will, quote, complicate our bilateral relations. the two countries have an extradition treaty. a security advisor told cbs, quote, hong kong has been a

historically good partner of the united states in law enforcement matters. and we expect them to comply with the treaty in this case. edward snowden had been staying in a hong kong hotel, but checked out june 10. it's assumed he's still in hong kong, but it's not clear. >> rick: if china wants to put up a fight or make it difficult for the u.s. to get snowden back here, is there any way for them to do that? >> yes. hong kong is largely in many ways controlled by china and one hong kong law maker says china may step in and make sure snowden is not extradited so that chinese intelligence can get ahold of any u.s. secrets and paperwork that snowden has with him. here is what one east asia analyst said about that. >> china gets all the information that snowden has one way or another. it may take longer than a couple days, but that's going to occur. i'm really concerned about that because snowden very well may have been working for them in the first instance. but even if he isn't, we know that that information is going to end up in beijing sooner or

later. >> another part of this story, an icelandic businessman connected to the wikileaks group, said he'll send a private plane to get snowden if iceland will grant him eye sigh lum -- asylum. presumely then his paperwork would end up on the wikileaks web site. they have not said if they will offer asylum. >> rick: molly henneberg, thanks very much. a little context now. snowden becomes the 7th person to be charged with espionage under the obama administration. other prominent suspects include army private first class bradley manning who is now on trial in a maryland military court. he was accused of passing more than 700,000 documents, classified files to wikileaks. former nsa official thomas drake, who eventually pleaded guilty for leaking information about alleged waste within the agency. former c.i.a. officer jeffrey sterling now facing charges

stemming from a 2011 case in which he was accused of illegally disclosing classified information about iran to a reporter for the "new york times." and former c.i.a. officer facing 2 1/2 years if prison for leaking classified information about the agency's interrogation program. >> arthel: a horrific plane crashed during an air show in ohio. the plane carrying two people, the pilot and a wing walker. the aircraft turning upside down as the stunt walker sits on top of the wing. but the plane suddenly slamming into the ground and exploding. it happened during the air show at dayton international airport. the pilot and wing walker killed instantly. no spectators were injured. >> rick: thousands of people marching through detroit today, commemorating an historic civil rights walk that took place 50 years ago. martin luther king, junior led tens of thousands of people back in 1963.

the civil rights leader also previewed his iconic i have a dream speech there. the detroits's naacp president says it serves that the work for freedom and justice must continue around the world. >> arthel: a comprehensive immigration bill in the u.s. senate getting a big boost. the so-called gang of eight who are writing the bill, making some of the most significant changes yet, including a $30 billion plan to fortify the u.s.-mexico border. it was one of the biggest sticking points for republicans. but will it be enough to insure their support? elizabeth prann has more from washington. >> the immigration reform bill starting to take shape in the senate, while republicans in the house continue to form what they think is a solution. this is as the president says the bill is a pathway that provides citizenship for folks who want to come here and stay here legally while bringing relief to a struggling economy. >> this bipartisan common sense bill will help the middle class grow our economy and shrink our

deficits by making sure that every workinger in america practice plays by the same rules and pays taxes. >> senators introduced a bill that would bolster border security. the measure includes 700 miles of fencing along the u.s.-mexico border with the addition of tens of thousands of border agents. it also enforces a nationwide everify system and needs to be in place before illegal immigrants can apply for green cards. with all the support it has, there is still no guarantee this will fly through the senate before the fourth of july recess. >> this current bill is a mess. it is repeating the same failed pattern we saw in 1986. today instead of 3 million people, we're dealing with 11 million people who are here illegally. and what congress is saying is the exact same deal, which is legalization first and then they're promising maybe some day in the future the border will be security. >> senate leaders took a crucial test vote on this plan. it could bring support for the

immigration bill close to 70 votes. that's the target number sponsors say, will pressure the dominantly republican house to act as well. arthel, back to you. >> arthel: all right. thank you very much from washington. >> rick: big news in the george zimmerman murder trial. less than 48 hours before opening statements are set to begin, the judge ruling today that audio experts who point to trayvon martin as the screamer on a 911 call moments before he was killed will not be allowed to testify. here is that tape. it's been played and analyzed over and over. take a listen. >> 911, do you need police, fire or medical? >> maybe both. i'm not sure. there is just someone screaming outside. ideas him. i don't know what's going on. >> rick: those screams seen as crucial pieces of evidence because they could determine who the aggressor was. martin's family contends it's their son screaming for help,

while zimmerman's father says it's his son. he is using a self-defense strategy here. the judge did open the door by allowing the tape to be played at the trial and let nonexperts, like family members testify to who may think heard screaming on that tape. >> arthel: new developments in another high profile murder case. police back on the scene today searching the massachusetts home of aaron hernandez. investigators linking him to a semi pro football player who was found dead nearby. meanwhile, hernandez is endorsing a deal with muscle milk, turning sour. the sports nutrition company dropping the patriots' tight end in light of the investigation. the district attorney's office has not said whether hernandez will face charges in the case, but boston media reporting he's now the subject of an arrest warrant on obstruction of justice charges. >> rick: the food network dropping host paula lean.

this comes days after the release of a video deposition taken in may in which she admitted to using the n word and several other racial slurs in the past. deen immediately took to youtube following the allegations, posting an emotional 46 second long video that was basically an apology and then it vanished a few minutes later. but not before it played on television nationwide. take a look. >> i want to apologize to everybody for the wrong that i've done. i want to learn and grow from this. inappropriate, hurtful language is totally, totally unacceptable. i've made plenty of mistakes along the way, but i beg you, my children, my team, my fans, my partners, i beg for your forgiveness. please forgive me for the

mistakes that i've made. >> rick: you might have been wondering or notice those white flashes that came up several times during that video. we did not put those in. paula deen's team edited the video that way and critics immediately harmed it. and minutes later, deen took down the video and posted, take two. >> but it's -- >> rick: we had a problem with the audio and then got it back. it appears neither apology was enough. at least not for the food network because within minutes of the second video posting, the network announced it would no be renewing her contract. we'll take a look. we do have that second video. >> your color of your skin, your religion, your sexual preference does not matter to me, but it's what is in the heart and my family and i try to live by

that. and i am here to say i am so sorry. >> rick: once again, paula deen's contract not renewed at the food network. >> arthel: antigovernment protesters in turkey returning to istanbul central square gathering to remember three demonstrators killed earlier in protests there. the crowd laying flowers and shouting antigovernment slogans. riot police firing water cannons to disburse them. it began may 31. but largely subsided this week. the turkish prime minister blaming the demonstrations on unspecified foreign groups. >> rick: secretary of state john kerry calling for an international resolution to end syria's bloody civil war. the secretary is in qatar in the middle east, meeting with his counter parts from several arab and european nations. it's the first meeting since president obama announced the u.s. would provide weapons to the syrian rebels. conner powell has this report

from jerusalem. >> nearly three-year long syrian civil war is entering a new stage tonight as the united states and other western and arab countries have agreed on a plan to provide direct military support against president assad. secretary of state john kerry said today that the u.s. still wants to pursue a diplomatic solution to the bloody conflict that killed more than 90,000 people. but that assad regime crossed a red line with its use of chemical weapons. >> what is clear is that every country committed today to step up what it is doing in direct response to what has happened on the ground. >> kerry also blamed iran in and hezbollah for stoking violence. the white house insisted that all military support would be channeled through the western backed rebel command.

but with the growing number of islamic extremists pouring into syria, including those affiliated with al-qaeda, insuring all u.s. military aid will go directly to the good rebels will be difficult if not impossible. rick? >> rick: conner powell reporting from jerusalem. thanks very much. >> arthel: well, the moon will be at its biggest and brightest of the year as it passes closer to earth than usual tonight's. the super moon will appear 14% larger than normal, which really isn't noticeable to the naked eye, but astronomers say it will still be worth a gander. as with any super moon events, high tides are in the forecast. but the effect is expected to be small. meteorologist janis dean is live with the fox extreme weather center. >> they always say that on a full moon, weird stuff happens. so what happens if this is super moon? super weird stuff going to happen. [ laughter ] we'll check in tomorrow. okay? so here is the deal with the

super moon. moon's orbit is not a perfect circle. if it was, it would alt always be the same distance to the earth. tonight and overnight, that's the average difference, 230,000 miles, as it gets closer, we'll be at 220,000 miles. so it will appear to be 14% closer, but in reality, 7% closer, and the closest we will see the moon to earth will be at 7:32, 6:30 eastern time. so we will certainly watch this and i know there is going to be a lot of video and a lot of pictures. watches and warnings. we have severe storms on the horizon, unfortunately. tornado watches until 6:00 p.m. mountain time for parts of wyoming, into south dakota and nebraska until 8:00 p.m. local time. and we have a tornado warning north and east of cheyenne. watching this developing cell looking like we have some rotation. we'll continue to monitor that. but throughout the evening, we're going to see the threat for severe weather for much of the plains states, up toward the

midwest and flash flooding, in some cases we've seen eight to 12 inches of rain already on the ground. ground is saturated. any more rain is going to cause flash flooding. sunday, not much movement here. we'll see the potential for hail, winds, tornadoes and more flash flooding in these areas that have seen incredible amounts of rain. so this is where we've seen the most rainfall across portions of wisconsin, in towards minnesota, in some cases eight to 12 inches on top of that. additional two to three inches flash flooding is occurring. we'll continue to monitor that and bring you the latest on the super moon. i've got lots of moon songs in my head. >> arthel: like what? ♪ a marvelous night for a moon ♪ . >> rick: good one. >> arthel: i like it. ♪ there is a moon out tonight >> very nice. >> arthel: thank you. >> rick: thank you, ladies for the little musical interlude. coming up next, new developments out of colorado where more than 100 national guard soldiers are now helping in the fight against

head. plus, southwest airlines now working through a back log of flights. the airlines was forced to ground hundreds of planes due to a system wide computer failure yesterday. >> arthel: turning to the irs scandal, new rasmussen polls show 70% of americans believe the calls to target conservative came from washington and of that 70%, 41% believe the call came straight from the white house. this as the house ways and means committee prepare to hold another hearing on restoring confidence in the tax agency. but can it be done? is that really the goal? joining us now for a fair and balanced debate, cal thomas, syndicated columnist and fox news contributor, and kristy sector. she is the president of new heights communications and former spokesperson for former vermont governor, howard dean. thanks for being here.

>> thanks for having us. >> arthel: what could make this process totally blow up and how likely is this to become a he said, she said process and it's all about the political divide? >> it is all about the political divide, arthel. the irs has been used by richard nixon and now surrogate of barak obama. the irs came in courtesy of the 16th amendment as high button shoes were going out, a century ago. what we need to do is get rid of the irs, repeal the 16th amendment, set up a fair tax or flat tax you and won't have the potential for these kinds of scandals. thinking that congress can reform an institution that both parties used for their own political ends by giving tax breaks to those contributors that help reelect them to office is like going to a funeral home and getting cpr to a corpse hoping it will revive. it isn't going to happen. >> arthel: kristy, cal came out strong out of the gate on that

one. your turn. >> as much as mitch mcconnell and apparently cal would wish, the fact is that the conspiracy theory caucus has lost on this one. the facts are in, the white house has had absolutely no involvement here. that's what the inspector general at the irs's report said. that's what the house oversight committee's own interview said as well. and i have to say, this particular scandal has never really made intellectcal sense. the irs is led by a conservative republican. why he'd be going after tea party groups has never really made sense to me. but i guess it's better than talking about the deficit. >> arthel: do you believe, i got your point there, but do you believe that the irs needs to be revamped to the core, not just facade. if so, what happens to be done in good faith? >> no, i don't believe that. i think there is a certain segment of the population for whom they will never like the irs. there is somebody who hates government or dislikes the president, if you're someone who

probably dislikes the irs before this, then no, there is nothing that the president or his administration can do to, quote, reform it. to the extent that you can, those things have already been done. it has been thoroughly investigated. there has been people who have already been fired. at this point, this serves as a republican effort to distract and discredit a president that they know that many members of their base already don't like. >> arthel: cal, we're going to get this 30-day report. what do you think we're going to hear come thursday? >> i'm not a prophet, but again, i think the problem -- it isn't just this president or previous presidents. it's the system itself, arthel. the whole idea of the progressives creating this monstrosity was to punish the successful and redistribute income to the less than successful. the real problem is not people who hate government. the problem is for people who want government to get back within its constitutional bounds. it's doing too many things that it is not constitutionally called to do. it is spending more money than we have.

$17 trillion in debt. it needs to get back to what the constitution says and then we wouldn't have some of these problems with the irs grabbing up more money than dracula drinks blood. >> it has nothing to do with the issue. i'm sorry. the fact is no one really did anything wrong here. you were talking about a group called the tea party. looking at their a 01 c 4 status about giving tax exempt status to a group which could be a political party. the irs people were doing their job here. i'm glad they are they were. >> the problem, kristy, is that they didn't have fair and balanced, given liberal groups. they were quickly approved. democrat pastors were allowed to preach and endorse from the pulpit. >> that's not true. it was far more nontea party groups. they were trying to target tea

party, they were doing an ineffective job. >> arthel: none the less, do you believe that -- you have insight. you study this, both of you study this and pay close attention. when you look at this and what has been reported, americans perhaps have lost confidence. some americans have lost confidence in the irs agency. do you think there needs to be a revamping? you say no. cal, you say yes. so what are we looking at here? something is going to happen of the do you think, kristy, is it going to be mission impossible or can the -- account faith in the irs, if you will, be restored? >> yeah. i think it's broader than the irs. i think it's faith in government generally. this is the real shame of this whole tragedy is that this whole so-called scandal is that people have lost faith in government. you see that congress has something like a 10% rating right now. and focusing on distractions like the irs, shows them that they are right when they believe that congress has no idea what average people care about. we're not talking about immigration or the economy or

>> arthel: welcome back. brazil's leader finally breaking her silence on massive sanity government protests. the country's president vowing to battle corruption and improve government services in response to the angry demonstrations in major cities. an increase in bus and subway fares sparked the protest. dominic dinatale has more. >> the president has been dragging her feet this past week. it was only late last night more than a week since the protests started that she addressed the demonstrators' demands. she pledged to battle corruption

and improve transport services. she also planned to pledge oil revenues in education. it was a sweeping statement. that wasn't enough. hundreds of thousands took to the streets again overnight and also in sao paulo. they've been joined by middle income families who are fed up with the rising tax burden. everyone it seems is angry. the bus fare hike was a moment of awakening. now we are fighting for better health care, security and education. >> i think that the people are really doing the right thing. the first phase has begun. >> the people are right to be demanding their rights. but only up to a certain point. when it's a question of breaking into shops, looting, stealing things, this has nothing to do with the protest movement. >> the violence has caused a handful of deaths and disrupting their greatest passion and also its greatest controversy now,

security concerns for the big soccer confederation cup taking place in brazil. it's drawn hundreds of thousands of fans from all over the world. protesters have been targeting sports venues, angry about lavish government spending on stadiums for the next year's soccer world cup, and they'll have the olympics in 2016. we've seen famous players who appeared on tv for the public to gather peacefully, they're saying, and some teams are so scared, they're considering pulling out if the violence doesn't subside. >> arthel: unfortunate. dominic, thank you. >> rick: some former investigatessors are trying to reopen the twa flight 800 case. you may remember that plane crashed off the coast of new york's long island in 1996. all 230 people on board were killed. the national transportation safety board concluded it was caused by a fuel tank explosion. but a new documentary repeating old theories that a missile actually brought down the jumbo jet. rick leventhal has the details.

>> the crash of twa flight 800 was one of the worst aviation disasters ever in u.s. territory. all 230 people on board died when the 747 exploded over the atlantic. soon after takeoff from jfk airport in july 1996. because of the possibility it was a terrorist attack, the f.b.i. joined the ntsb and investigating the crash. 16 months later, the f.b.i. determined it was not a criminal act and four years after the accident, the ntsb released its conclusion. flight 800 blew up because of faulty wires, sparking vapors in the center fuel tank. >> there was grass mismanagement of the evidence -- gross mismanagement of the evidence and other facts that should have been appropriately considered and they weren't by either the f.b.i. or the ntsb. >> rick: hank hughes is one of several former crash investigators taking part in a new documentary calling the official finding the flawed and driven by agenda, claiming a massive cover-up for unknown

reasons. the film makers say the evidence shows there was an external explosion, likely caused by a missile. >> this documentary presents the facts that disproves the official theory and proves beyond any reasonable doubt, that a detonation caused this crash. hard radar evidence proving that. >> there is no reason to cover up anything. >> jim, who headed the f.b.i.'s new york office at the time of the crash, and led the criminal investigation, says the documentary is preposterous. he says the f.b.i. exhaustively examined the possibility of a missile with the sole agenda of finding the truth. >> we had a full court press with months and mons of that theory. but the reality was there is no evidence of a missile hitting the plane. either outside the plane, inside the plane, penetrating the plane, concussion from a missile, there is no evidence of it. >> the film makers filed a petition with the ntsb to reopen the investigation. the agency says it will review that petition to see if this

>> rick: snowden charged with espionage and charged with theft of government property, and still believed to be hiding out in hong kong. the department of justice today confirming that our state department has submitted a formal extradition request for snowden from hong kong. but that doesn't necessarily mean that the authorities will be quick to hand him over. susan estridge, professor of law and prettycal science at the -- political science at the university of southern california. how is this going to go down? what are authorities in hong kong going to do with this request? >> move slowly, i think is the short answer and the long answer. this is going to be a long process. there are many of us, myself included, who are really troubled by what this guy did and troubled that it could cost american lives and cost lives around the world. but that isn't going to speed up the process. hong kong is going to have to decide whether it's going to turn him over. he may request political asylum. he's got some supporters over there. hard as that is to believe for some of us. then whatever they decide at the

initial level, there will be an appeal. at the end of the day, the chinese government, 'cause hong kong is sort of a semi autonomous state, it is part of china. at any point the chinese government can come in and decide that they don't want to send him here. so experts are saying this could in america.ly years before he >> rick: i understand the filing on the part of the u.s. does prevent snowden from traveling. he must now stay if, in fact, he is in hong kong, that's where he's got to stay. so what kind of power does the united states have, even as he's over there halfway around the world? >> well, we do have an agreement with hong kong that predates i guess incorporation by china. so we'll go under that agreement. they'll block him from traveling. he certainly is not going to be using his passport and taking trips around the world. if he leaves hong kong, then he would have to do so

surreptitiously. we have interpol. so basically he's stuck in hong kong. it's not clear whether he'll come out of hiding or not. it's not clear whether the hong kong officials, they're not saying anything. so theoretically, the police could arrest and detain him. but it's not clear that they've done that. there is some web site saying he's in a safe house provided by authorities in hong kong. it's kinds of hard to figure out which side hong kong is on in all of this. of course, you got delicate relations with china, as you well know, because we've been very tough on them for their cyber snooping. so there are tensions there. so as frustrating as this is, i know for many people watching saying what this guy did, or alleged to have done, is so clearly wrong. he's owned up to it. we've had american officials telling us seriously that this could cost lives and meanwhile, we're going to now spend years in the extradition law to try to

get this guy back to face justice. >> rick: i've got less than a minute left. what's the legal precedent here if we jump ahead and we figure he eventually winds up back in the u.s. and he faces these charges? we had the pentagon papers, we've had a whole other series of people in this administration that have been charged with espionage. where does this go? >> he's charged with three counts, maximum penalty on each count is ten years. some people will say, as i do, that what he did is causing serious vulnerability, is a serious crime. others will say, well, what's the difference between that and daniel elseberg? the difference is he might have saved lives. this guy, unfortunately, i fear, could cost lives. >> rick: susan estridge, always good to see you. look for susan's column in newspapers around the country and we'll see you again real soon. arthel is out on the plaza. >> arthel: yes. i have my hat, i have my shades.
